These Trademark and Logo Usage Guidelines (“Guidelines”) set forth the rules established by EBSCO Information Services, LLC (“EBSCO”) for using or referring to EBSCO’s brands, trademarks/service marks, product and service names, logos and slogans (collectively, the “EBSCO trademarks”). They apply to all EBSCO companies and affiliates worldwide and to various business partners of EBSCO who may be authorized by EBSCO to use any of the EBSCO trademarks in connection with their activities on behalf of EBSCO (e.g., resellers, developers, customers, advertising agencies, consultants, professional writers and editors, licensees and other third parties making reference to EBSCO trademarks). EBSCO reserves the right to modify these Guidelines as it deems necessary or appropriate, including by written agreement or license with third parties.
EBSCO considers its marks to be an important part of the brand identity for the entire company, and it is important that such marks not be altered in any way. To ensure that EBSCO maintains consistent brand recognition, we require that all users of EBSCO’s trademarks adhere to these Guidelines.
Rules of Proper EBSCO Trademark Use
A. EBSCO Trademarks Should be Used as Adjectives and Never as Nouns
Every EBSCO trademark should be followed by an appropriate noun consisting of the generic term for the EBSCO product or service that is branded with the mark. EBSCO trademarks are adjectives and may not be used as nouns, or alone as a shorthand way of identifying a product or service. The EBSCO trademark should be used as an adjective describing a product or service of EBSCO. Examples of proper and improper use are as follows: [proper use: Articles and abstracts can be found on the EBSCO HOST database. Improper use: Articles and abstracts can be found on EBSCO HOST]. The only exception to this requirement is when the “EBSCO” name is used as our company name as opposed to an identifier of one of our products or services (see Guideline C. below).
B. No Possessives, Plurals, Verbs or Puns
EBSCO works hard to build customer goodwill, and it uses its marks to harness that goodwill. Please use the marks as they are designed and intended. Since a trademark is not a noun, it must never be used in possessive or plural forms, and should never be used as a verb or a pun.
C. Use of Name of Company
The “EBSCO” name is not only a trademark used to identify our products and services, it also serves as our company name. When using the “EBSCO” name as a reference to the company, “EBSCO” may be used as a noun and no TM symbol is needed. For example, the sentence “EBSCO announced a new line of products” would be an appropriate use.
D. Use Proper Trademark Attribution — Symbols and Legends
EBSCO trademark attribution is often described in one of two ways: (1) with the use of the appropriate trademark/service mark symbol (TM, tm, SM, sm, or ®) after the mark, and/or (2) with a trademark legend, usually found at the end of a document in legible text following the copyright notice. The ® symbol should only be used with marks that have been federally registered with the U.S. Patent and Trademark Office. The TM and tm symbol are used to represent common law trademark for tangible goods and products. The SM and sm symbol are used to represent common law service mark for services provided by EBSCO.
Assuming that your company has the right to use an EBSCO trademark, it should always be accompanied by a proper mark symbol and/or legend.
Outlined below is a non-exhaustive list of EBSCO’s marks that is updated periodically. Because EBSCO is constantly adopting and using new marks, the absence of a mark from the following list is not a waiver of any of EBSCO’s rights.
